These terms are an agreement between you and ElimX Private Limited ("ElimX", "we", "us"), the company that operates FitMe. By creating an account or using FitMe at fitme247.co or app.fitme247.co (together, the "Service"), you agree to them. If you do not agree, please do not use the Service.

1. Who we are

FitMe is owned and operated by ElimX Private Limited, a company registered in India with its registered office in Kerala. Our parent company website is elimx.co. References to "FitMe" in these terms mean the Service; references to "we" or "us" mean ElimX Private Limited.

2. Eligibility and your account

You must be at least 16 years old to create an account. If you are under 18, you may only use FitMe with the consent and supervision of a parent or guardian.

You are responsible for:

• Giving accurate information when you sign up and when you complete your fitness profile. Your plans are calculated from this, so inaccurate details produce unsuitable plans.
• Keeping your password confidential and for all activity under your account.
• Telling us promptly if you believe your account has been accessed without permission.

One account is for one person. Do not share your login with others.

3. Health, safety and the limits of our guidance

This is the most important section of these terms. Please read it carefully.

What FitMe is

FitMe generates workout and nutrition suggestions from the profile you provide, using established formulas and training principles. Exercise instructions, form cues and nutrition targets are general educational information.

What FitMe is not

FitMe is not a doctor, physiotherapist, dietitian or licensed medical professional, and nothing in the Service is medical advice, diagnosis or treatment. Calorie and macro figures are estimates from standard equations, not measurements of your body. Where AI is used to generate exercise explanations, its output may occasionally be incomplete or incorrect and should be treated as a starting point, not instruction from a coach.

Your responsibilities

• Get medical clearance before starting if you have any health concern.
• Train within your ability. Reduce the weight, reduce the range, or stop.
• Stop immediately and seek medical help if you feel chest pain, dizziness, faintness, breathlessness beyond normal exertion, or sharp or unusual pain.
• Use equipment safely and use a spotter for heavy lifts where appropriate.

Exercise carries an inherent risk of injury. By using FitMe you accept that risk and agree that you train at your own risk.

4. Trainers and bookings

FitMe lets you find and book sessions with fitness trainers. Trainers are independent professionals, not employees or agents of ElimX. We facilitate introductions, scheduling and messaging; we do not supervise, direct or guarantee the sessions themselves.

• Each trainer sets their own rate, availability and session format.
• A booking request is confirmed only when the trainer accepts it.
• Any contract for a training session is between you and that trainer.
• We are not responsible for a trainer's advice, conduct, punctuality or qualifications, although we remove trainers who are reported for poor conduct.

Where you share your plan or training history with a trainer, you consent to them seeing that information for the purpose of coaching you.

5. Plans, payments and refunds

The Free plan is available at no cost and requires no payment details. We may change what the Free plan includes, but we will not remove core functionality you already rely on without notice.

Paid plans, where offered, are billed in advance for the stated period through our payment provider. We do not see or store your full card details. Where a paid plan is described as "coming soon", it is not available for purchase and no charge can be made.

Because digital plans are delivered immediately, subscription fees are generally non-refundable once the period has begun. If you were charged in error, or the Service was unavailable for a prolonged period, contact us and we will put it right. This does not affect any rights you have under Indian consumer law.

Trainer session fees are set and collected as described at the time of booking, and cancellation terms are those stated by the trainer.

6. Acceptable use

You agree not to:

• Use FitMe for anything unlawful, or to harass, abuse or impersonate anyone.
• Attempt to access another user's account or data.
• Probe, scan or test the security of the Service, or bypass any access controls.
• Scrape, copy or resell content from the Service, or use it to build a competing product.
• Upload anything unlawful, offensive, or that infringes someone else's rights.
• Overload the Service with automated requests.

We may suspend or remove accounts that breach this section.

7. Your content and our content

You keep ownership of what you put into FitMe: your profile, custom plans, session logs, photos and messages. You grant us a limited licence to store and process that content for the purpose of operating the Service for you.

FitMe's name, logo, design, written content, exercise guides and illustrations are owned by ElimX Private Limited and may not be copied or reused without written permission.

8. Availability and changes to the Service

We work to keep FitMe available and accurate, but we provide it "as is". We do not guarantee uninterrupted access, and we may add, change or remove features as the product develops. Planned maintenance will be announced where practical.

9. Ending your account

You can delete your account at any time from your profile. Deletion permanently removes your profile, plans, training history, bookings, messages and notification settings. It cannot be undone.

We may suspend or close an account that breaches these terms, or where required by law. Where reasonable, we will tell you why.

10. Liability

To the fullest extent permitted by law, ElimX Private Limited is not liable for:

• Injury, illness or health outcomes arising from exercise or dietary choices you make while using FitMe;
• The acts, omissions or advice of independent trainers booked through the Service;
• Indirect or consequential loss, including lost income or lost data;
• Interruptions caused by third parties such as hosting, payment, messaging or AI providers.

Where liability cannot lawfully be excluded, it is limited to the amount you paid us in the twelve months before the claim arose, or ₹1,000, whichever is greater.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

11. Governing law

These terms are governed by the laws of India. The courts of Kerala, India have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections available to you where you live.

12. Changes to these terms

We may update these terms as the Service changes. The "last updated" date at the top will change, and for significant changes we will notify you in the app or by email. Continuing to use FitMe after a change means you accept the updated terms.
